Refund policy
Return and Refund Policy for Seat and Sleep Gallery
At Seat and Sleep Gallery, we are committed to complying with the South African Consumer Protection Act (CPA) and the Electronic Communications and Transactions Act (ECTA). To ensure a transparent process and protect both our customers and our business, the following terms apply to all purchases.
1. Defective Goods (The 6-Month Warranty)
Under the CPA, goods carry an implied warranty of quality for 6 months from the date of delivery. If an item is structurally defective or faulty within this period, we will repair, replace, or refund the item at the customer's discretion.
Exclusions:
This warranty strictly does not cover:
* Damage caused by normal wear and tear.
* Damage arising from negligence, user abuse, or incorrect usage.
* Damage caused by inadequate care, improper cleaning chemicals, or unauthorized alterations.
* Damage resulting from incorrect assembly by the customer.
* Damage caused by electrical surges or lightning (applicable to motorized/adjustable beds).
* Any defects that were explicitly pointed out to the customer prior to purchase (e.g., on clearance or floor models).
* After 6 months: Any claims made after the initial 6-month CPA period will be subject strictly to the manufacturer’s warranty terms, if applicable. Seat and Sleep Gallery will act as a facilitator, but the manufacturer dictates the repair or replacement outcome.
2. Hygiene Exemptions (Bedding & Mattresses)
Due to strict public health and hygiene regulations, mattresses, mattress protectors, pillows, and bed linen are exempt from any "change of mind" returns or exchanges.
* These items will only be accepted for return if they are found to be structurally defective within the 6-month warranty period.
* In the event of a claimed defect on a mattress, the item will be subject to a formal inspection by the manufacturer before any replacement or refund is authorized. Soiled or unsanitary mattresses will not be accepted for inspection under any circumstances, rendering the warranty void.
3. Delivery, Access, and Measurements (Customer Responsibility)
It is the sole responsibility of the customer to ensure that the purchased furniture will fit into their premises.
* No returns or refunds will be granted if the furniture does not fit through doorways, hallways, staircases, or into the designated room.
* If a delivery cannot be completed due to access issues, the customer will be liable for the delivery fee, the return transportation fee, and a 15% restocking fee.
4. Custom, Bespoke, and Special Orders
Any item that is custom-made, ordered in a specific fabric or color at the customer's request, or altered to specific dimensions is strictly exempt from standard returns and cooling-off periods (as per Section 20 of the CPA).
* The customer is 100% responsible for the accuracy of any measurements or specifications provided to Seat and Sleep Gallery.
* Once a custom order goes into production, deposits are non-refundable.
5. Natural Variations (Wood, Leather, and Fabric)
Furniture is often crafted from natural materials.
* Wood and Leather: Natural markings, grain variations, scars, and slight color differences in timber or genuine leather are hallmarks of natural products and are not considered defects.
* Fabric: Slight dye-lot variations can occur between the fabric swatch seen in-store and the final product. These slight variations do not constitute a defect and will not be accepted as grounds for a return.
6. Online Purchases (7-Day Cooling-Off Period)
For purchases made exclusively online (unseen), the ECTA grants a 7-day cooling-off period.
* You may cancel your order within 7 days of delivery.
* The Loophole Closed: The item must be returned unassembled, unused,
completely pristine, and in its original, undamaged packaging.
* The customer is entirely responsible for the risk and cost of returning the item via
a reputable courier. The original delivery fee will not be refunded.
7. In-Store Purchases (Change of Mind)
For purchases made physically in our showroom, the CPA does not legally require us to accept returns for a "change of mind."
* Seat and Sleep Gallery enforces a strict no-refund policy for change of mind on in- store purchases once the goods have been delivered and accepted.
* At management’s sole discretion, we may allow an exchange for store credit within 7 days, subject to a 15% handling and restocking fee. The item must be returned
in its original, unopened packaging at the customer's expense.
8. Unsuitable for Intended Purpose
If a customer requires a product for a highly specific or unusual purpose, they must declare this in writing to our sales staff prior to purchase. If the item is then found to be unsuitable for that explicitly documented purpose, it may be returned within 10 days. Verbal claims of "unsuitability" will not be entertained.
9. Clearance and Floor Models
All items sold as "Clearance," "Floor Model," "As Is," or "Display Stock" are sold with all inherent visible flaws. These items are strictly non-returnable and non-refundable, except in the case of a fundamental structural failure not apparent at the time of sale.
10. Refunds Processing
* All goods returned for a refund or exchange are subject to a thorough inspection by our warehouse team before the refund is authorized.
* Approved refunds will be processed via EFT within 7 to 14 business days after the goods have been inspected and cleared. No cash refunds will be issued.
* If a returned item is found to be damaged by the customer, the return will be rejected, and the customer will be responsible for the cost of collecting the item from our warehouse within 14 days, after which storage fees will apply.
